Regulations for individual transport of disabled people in Lublin

Chapter I – General provisions

§ 1

“Regulations for the individual transport of disabled persons in the area of the city of Lublin” shall specify the rules of organisation and operation of the individual transport of disabled persons in Lublin.

 

§ 2

Whenever there are references in the regulations to the following terms, they shall have the following meaning:
1.”Regulations” – “Regulations for the individual transport of disabled persons in the area of the city of Lublin”,
2.”Disabled person” – persons with valid disability certificates (or equivalent certificates) and persons up to the age of 16 with a disability certificate.
3.”Carrier” – entity providing transport services for the disabled,
4.”Passenger” – the disabled person,
5. “Guardians” – guardian or person accompanying the disabled person,
6. “Order” – ordering a passenger transport service made by phone, electronically or in writing with a return receipt confirmation.
7. “Transport” – individual transport services for the disabled,
8. “Table of fares” – the current price list of fares for transport services for the disabled,
9. “Vehicle” – a motor vehicle which, due to its construction and equipment, is suitable for transporting up to nine persons including the driver, and adjusted for transporting disabled persons in wheelchairs.
10.”Individual transport” – transporting one disabled person on the basis of a special order, paid according to the fare provided in the table.
11. “Collective transport” – transporting two or more disabled persons on a designated route.

 

Chapter II – General rules of the individual transport of disabled persons

 

§ 3

1. The following residents of Lublin registered for permanent or temporary stay shall be granted priority in using the transport:
a) disabled persons with a certificate confirming the severe or moderate degree of disability, using wheelchairs.
b) disabled persons due to motor dysfunctions, neurological diseases or mental disability, with a severe or moderate degree of disability, unable to use public transport on their own.
2. Transport of disabled persons are provided within the administrative borders of Lublin for a fare, according to the table attached to the Regulations. The table of fares should be put in a visible place in a vehicle.
3. Transport services shall be provided on all weekdays and on Sundays and holidays, depending on needs and capabilities.
4. Transport services for disabled persons shall be carried out on weekdays, from 6:00 am to 6 pm, on Saturdays, Sundays and holidays, as required. In particularly justified cases, transport can be provided within hours others than specified, on the condition of ordering such transport at least two days in advance, and for a non-working day - on the preceding working day.
5. Transport orders shall be received from 7 am to 2 pm, one day in advance, via phone (81 533 33 10), electronic mail (komunikacjadlaniepelnosprawnych@mpk.lublin.pl) or in writing to the address Miejskie Przedsiębiorstwo Komunikacyjne Lublin Sp. z o. o., ul. A. Grygowej 56, 20-260 Lublin. Orders shall be completed after sending a return receipt confirmation.
6. The carrier shall be entitled to combine the transport of the disabled living at a close distance in order to ensure an efficient use of vehicles.
7. Transport services provided abroad or for more than one day shall be subject to separate agreements and price negotiations.
8. Complaints and suggestions concerning the individual transport of disabled persons shall be filed to the Public Transport Authority in Lublin (ul. Nałęczowska 14, 20-701 Lublin).

 

Chapter III – The rights and responsibilities of passengers

 

§ 4

1. Disabled passengers, in particular, those in wheelchairs, are entitled to paid individual transport according to the table of fares.
2. The order should state the following:
a) personal details of the passenger, including the address and contact details
b) data and hour of transport service
c) starting point and destination, and possibly the route.
3. Passengers are entitled to travel with one accompanying person as a guardian without any additional charge.
4. Passengers shall have the right to travel with hand luggage.
5. Passengers are entitled to the driver’s free-of-charge assistance in embarking on and alighting from the vehicle, and, if possible, moving from the door of the building, to the vehicle and back.
6. If the person who ordered the service decides not to use it after the vehicle has arrived at the location specified in the order, he/she shall bear the costs according to the table of fares.
7. The passenger is obliged to follow the transport safety instructions provided by the driver.
8. The passengers who are minors or with whom no contact can be established, can use the service only when accompanied by an adult guardian or family member.
9. In the event when it is necessary to carry a disabled person, the person and his or her guardian are obliged to seek the assistance of a person other than the driver.

 

Chapter IV - The rights and responsibilities of the carrier

§ 5

1. Ensuring the vehicles’ service capacity,
2. Accepting orders for individual transport services,
3. Informing the passengers about any changes, including the date or hour of the service and time of travel,
4. Engaging drivers for transporting the disabled who are professional, well-mannered and presentable, with highly developed communication skills, patience, understanding, and characterised with considerable physical strength.
5. Providing transport services for the disabled as ordered, with due care for their quality,
6. Checking the passengers’ entitlements for using the services,
7. Collecting transport payments in accordance with the applicable fare,
8. Taking responsibility for damage occurring during the travel, including injuries sustained by the passengers,
9. Providing first aid to the passengers and calling an ambulance,
10. Free-of-charge assistance in embarking on and alighting from the vehicle, and, if possible, moving from the door of the building to the vehicle and back.
11. Tactful and kind attitude towards the passengers and guardians,
12. The carrier is entitled to refuse to accept an order for a specific date and hour if it exceeds the available service capacity due to the previously accepted orders; the carrier is obliged to arrange the service on a different day,
13. The carrier has the right to refuse to provide the ordered transport services due to the inability to fasten the wheelchair or when the passenger’s luggage poses a threat to the safety of other passengers or the driver.
